1. Our agreement
Heckler Golf provides a browser golf game, member accounts, social play and related services at heckler.golf. These Terms are an agreement between you and the operator identified above, referred to as “Heckler,” “we” or “us.” Review them before accepting. If you do not agree, do not create an account or enter a competition. The Privacy Policy explains our information practices; acknowledging it is not blanket consent to every possible use of personal information.
Paid or prize competitions are offered only when expressly available to you through an official entry flow. They require the Paid Competition Terms, where applicable, and the Official Rules for that specific event. A free friend invitation, displayed event, scorecard or member pass is not a paid entry or promise of a prize. You may not use Heckler to solicit or settle unrelated side bets, spectator wagers or payments between users.
Applicable law takes precedence. Event Official Rules control event-specific entry amounts, timing, scoring and awards; the Paid Competition Terms control general paid-entry, verification, refund and settlement procedures; these Terms govern the remaining service relationship. Event rules cannot remove mandatory consumer rights or the promised remedy for an operator technical void. An advertisement or informal host message cannot change an accepted event contract.
2. Eligibility and accounts
You must be at least 18 and the age of majority where you live to create an account. Paid or prize events require you to be at least 21 and satisfy their additional eligibility conditions. Paid competitions, if introduced, will initially be limited to eligible people in specified U.S. jurisdictions. Free-game access outside the United States does not establish paid eligibility, and mandatory local consumer rights remain applicable. Account registration alone does not establish paid eligibility.
Provide accurate information, use a phone number you control and keep authentication codes and sessions private. Use your own account for competitive play. Do not impersonate someone, evade a suspension, buy or sell accounts, or create extra accounts to obtain an advantage. Tell support promptly if your account is compromised. We will investigate unauthorized activity; this provision does not make you automatically liable for all activity you did not authorize or waive payment-law rights.
Choose a respectful display name that you are entitled to use. It may appear with your member code, match results or event ranking. Your phone number is not a public player lookup. Do not put contact information, another person's private information or unlawful content in a display name.
3. Game access, saves and records
We grant you a personal, limited, nonexclusive, nontransferable right to use the service as permitted by these Terms. Courses and free features may change. Local saves depend on your browser and device; clearing storage or switching browsers can remove unsynchronized progress. Online services can experience errors, interruptions or maintenance. Solo results imported from a browser may be distinguished from server-scored match records.
We may correct demonstrable scoring or record errors and will apply the event-specific review procedure when an award is affected. We will not change accepted paid rules or prize economics after entry merely because an outcome is unfavorable to Heckler or a sponsor.
4. Fair play and social conduct
Play your own shots and follow the Fair Play Policy. Do not use bots, scripts, manipulated clients, timing injection, undisclosed competitive assistance, collusion or multiple identities to affect a competition. Do not intentionally disconnect to escape a losing result, tamper with location/identity checks, exploit a vulnerability for advantage, harass players or disrupt systems. Accessibility tools that do not automate competitive decisions are not categorically prohibited; contact support about a necessary accommodation before paid entry.
Share private match links only with intended players. Possession of a link may expose limited lobby information and allow a request to join. A match invitation does not automatically create a friendship. Use available remove/block controls or report abuse. Friends and hosts have no authority to speak for Heckler, collect entry money on our behalf or decide official payouts.
5. Our materials and your content
Heckler and its licensors retain rights in the software, course art, branding, audio and other service materials. Rights supplied under third-party or open-source licenses remain subject to those licenses. Do not copy, sell, distribute or exploit protected materials beyond permitted personal use or applicable legal rights. Do not use our names or marks to imply sponsorship without permission.
You retain rights you have in content you submit. You grant us the limited rights needed to store, display, moderate and transmit that content to provide the service and its requested social/event features. This is not a general license to use your likeness in advertising. Any testimonial, photo or promotional endorsement beyond routine event-result display requires a separate permission. Feedback may be used to improve the service without an obligation to compensate you; do not submit confidential third-party material.
Report alleged infringement to hello@heckler.golf, identifying the material, location and basis of your concern. We will review reports and respond as appropriate. This contact provision does not claim that Heckler has registered a DMCA agent or qualifies for a statutory safe harbor.
6. Messages and the optional member pass
Authentication texts follow your separate SMS request and consent, as described in the SMS Terms. They do not enroll you in marketing texts. Electronic account and transaction notices may be provided within the service or through a contact channel you have supplied for that purpose. A paid event must provide a way to retrieve its entry receipt and applicable rules.
Adding a member pass to Apple Wallet is optional. The pass can show your member identity, match record and event information. It is not a payment account, identity-verification document or guarantee of access to a prize event. Apple controls installation, display and delivery behavior. Public pass updates are silent by default. A separately disclosed internal alert pilot applies only to eligible test participants who opt in; an update request does not guarantee an alert. Apple does not sponsor or administer Heckler competitions.
7. Sponsors and external services
We may display sponsorships and links. External sites and services have their own terms and privacy practices. An advertisement does not authorize a cash event or guarantee a sponsor's products. For an official prize event, the published rules identify who owes the prize and any fulfillment provider. Calling another business a sponsor does not excuse Heckler's express contractual obligations to entrants.
8. Restrictions, suspension and ending an account
We may restrict access when reasonably necessary to address a material breach, security threat, legal requirement or risk to fair play. Where lawful and practicable, we will explain the action and provide a route to review through hello@heckler.golf. We may limit the explanation to avoid exposing another person's information, compromising an investigation or violating law.
Account closure does not automatically forfeit an undisputed refund or earned award. A pending investigation is handled under the Paid Competition Terms. You can stop using the service and request deletion through available Account settings or support. Some records may remain for the reasons explained in the Privacy Policy. Provisions concerning accrued obligations, necessary content rights, disputes and limitations survive only as needed to give them effect.
9. Service warranties and responsibility
To the extent applicable law permits, the free service is provided as available, without a guarantee of uninterrupted operation or error-free scores, and without implied warranties of merchantability, fitness for a particular purpose or noninfringement. This clause does not displace an express paid-event promise, a required refund or a warranty that cannot legally be excluded.
To the extent permitted by law, neither party is liable to the other for indirect, special or consequential loss that was not reasonably foreseeable from the breach. Heckler's aggregate liability for other covered service claims is limited to the greater of $100 or the amounts you paid Heckler for services in the 12 months before the event giving rise to the claim.
That cap and the exclusions do not apply to money we owe as an entry refund or earned award, our fraud, intentional misconduct or gross negligence, breach of confidentiality/data-security obligations, death or personal injury caused by our negligence, or any liability or remedy the law does not permit us to limit. These terms do not shift our regulatory duties to players.
10. Disputes and applicable law
Contact hello@heckler.golf with the issue and relevant account/event reference so we can try to resolve it. Do not send passwords, verification codes, full payment credentials or identity documents by ordinary email. The event review procedure concerns contest administration and does not replace legal remedies or shorten a statutory limitation period. Contacting support is encouraged but does not bar urgent relief, complaints to a regulator, small claims or payment-provider rights.
Subject to mandatory protections where you live, Colorado law governs these Terms without its conflict-of-laws rules. Courts with jurisdiction in Denver, Colorado are the agreed forum except where applicable law gives you a nonwaivable right to proceed elsewhere. These Terms do not impose mandatory arbitration or waive class proceedings. Any future dispute mechanism needs separate review and valid prospective acceptance.
11. Changes and general provisions
We will post changes with a new effective date and provide notice of material changes through an appropriate service or account channel. Changes apply prospectively. We will obtain renewed acceptance where required and will not retroactively rewrite an accepted paid event. If a provision is unenforceable, the remaining provisions continue to the extent lawful. A failure to enforce once is not a continuing waiver.
You may not transfer your account or contract without our consent. A lawful business transfer may include our service obligations and information subject to the Privacy Policy and required notice; it does not cancel player remedies. These Terms and the applicable event documents form the agreement about the service, preserving rights that cannot be excluded. Questions and legal notices may be sent to the operator contact above.
